Terms and conditions of sale

1. Purpose and scope

These terms and conditions govern sales of products concluded on suki-paris.com between Suki Paris and any private individual making a purchase, hereinafter “the customer”.

They apply to the exclusion of all other terms. The customer acknowledges having read and accepted them before confirming an order. Confirming an order constitutes full acceptance of these terms in the version in force on the day of the order.

2. The seller

Products are sold by Amandine Simon, sole trader under the French micro-entreprise regime, trading under the business name Suki Paris.

3. Products

The products offered are leather goods handmade in the Parisian atelier at 6 rue Labie. They are described and presented as accurately as possible.

Leather is a natural material: the grain, variations in tone and the marks particular to each hide are characteristics of the product, not defects. Photographs cannot guarantee a perfect rendering of colours, which varies from one screen to another.

Products are made in small batches. A piece shown may become unavailable; should unavailability be established after an order is placed, the customer is informed and refunded in full.

4. Prices

Prices are shown in euros, all taxes included, excluding delivery costs. As Suki Paris falls under the French VAT exemption scheme, no VAT is charged. Orders delivered to Japan are invoiced in yen.

Delivery costs are calculated and displayed before the order is finally confirmed, according to the destination and the shipping method chosen. Delivery is free from €100 within mainland France and from ¥40,000 to Japan.

Suki Paris reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is recorded.

For deliveries outside the European Union, customs duties and import taxes may apply under the regulations of the destination country. These remain payable by the recipient.

5. Orders

The customer selects the products, enters any personalisation options, then confirms the basket. Before confirming, a detailed summary of the order, the total price and the delivery costs is provided, and any errors may be corrected.

Confirmation of the order, together with payment, forms the contract of sale. A confirmation email summarising the order is sent to the customer.

Suki Paris reserves the right to refuse or cancel any order on legitimate grounds, in particular in the event of a prior dispute with the customer, a manifestly abnormal order or suspected fraud.

6. Personalisation

Most pieces can be personalised by hot stamping — gold, silver or natural. The text is limited to a first name of fewer than eight characters, a single initial or a date in short format. The option is added at the time of ordering, at the rate shown on the product page.

Hot stamping compresses the leather in depth: it is permanent and can neither be removed nor altered. Confirmation of the exact wording is sent to the customer before the stamping is carried out.

In accordance with article L221-28 3° of the French Consumer Code, personalised products are excluded from the right of withdrawal. This exclusion is brought to the customer's attention before the order is confirmed.

7. Payment

Payment is made online at the time of ordering, using the methods offered at checkout. The transaction is handled by a secure payment provider; Suki Paris never has access to the customer's bank details.

Orders are processed only once payment has actually been received. Should authorisation be refused, the order is automatically cancelled.

8. Delivery

Orders without personalisation are dispatched within 2 to 3 working days from the Parisian atelier. Personalised orders require a further 7 to 10 working days of making before dispatch.

Within mainland France, delivery then takes 2 to 3 working days depending on the method chosen. Timescales and costs for other destinations are displayed before the order is confirmed. Collection from the atelier is also available.

All orders are dispatched with tracking. The timescales given are average timescales and run from confirmation of the order; a delay cannot give rise to cancellation or compensation, without prejudice to the customer's rights under article L216-6 of the French Consumer Code.

Should a parcel arrive damaged, the customer is invited to write to hello@suki-paris.com within 48 hours, enclosing a photograph of the parcel and of the piece. Where loss is confirmed by the carrier, Suki Paris will either send a replacement or issue a refund, at the customer's choice.

9. Right of withdrawal

The customer has fourteen days from receipt of the order to exercise the right of withdrawal, without giving reasons and without penalty.

To do so, a clear and unambiguous request should be sent to hello@suki-paris.com before the deadline expires. Products must be returned complete, in their original condition, unworn and unused, in their packaging, no later than fourteen days after notification of the decision to withdraw.

Return costs remain payable by the customer. All sums paid, including standard delivery costs, are refunded within fourteen days of recovery of the products, using the same means of payment as that used for the order.

In accordance with article L221-28 3° of the French Consumer Code, this right does not apply to products that are personalised or made to the customer's specifications.

10. Legal guarantees

Independently of any commercial guarantee, Suki Paris remains liable for lack of conformity and for latent defects under the conditions provided by law.

• Legal guarantee of conformity (art. L217-3 et seq. of the French Consumer Code): the customer has two years from delivery of the goods to bring a claim, and may choose between repair and replacement, subject to the cost conditions provided by law. The customer is not required to prove the existence of the defect during the twenty-four months following delivery.
• Guarantee against latent defects (art. 1641 et seq. of the French Civil Code): the customer may bring a claim within two years of discovering the defect, and obtain rescission of the sale or a reduction in price.

Normal wear of the leather, the patina that develops with time and use, and damage resulting from a lack of care, immersion or improper use, do not fall within these guarantees. Repair at the atelier remains possible in such cases, subject to a quotation.

11. Complaints and mediation

Any complaint may be sent to hello@suki-paris.com. Suki Paris undertakes to reply as promptly as possible and to seek an amicable solution.

In accordance with article L612-1 of the French Consumer Code, the customer may refer the matter free of charge to a consumer mediator with a view to the amicable resolution of the dispute, after first attempting to resolve it directly with Suki Paris. Competent mediator: [médiateur à désigner].

12. Personal data

The data collected when an order is placed is necessary for processing and following up that order. Its processing, the retention periods and the rights available to the customer are set out in the privacy policy.

13. Intellectual property

All elements of the site — texts, photographs, creations, designs and the brand — are protected by intellectual property law and remain the exclusive property of Suki Paris. Any reproduction or use, in whole or in part, without prior written authorisation, is prohibited.

14. Force majeure

Suki Paris cannot be held liable for failure to perform its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code. Obligations are then suspended for the duration of the event.

15. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts have jurisdiction, without prejudice to the protective rules from which the consumer benefits under the law of their habitual residence.
